By downloading or using the Mooch app, you agree to these Terms of Service. Please read them carefully before using the app.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Mooch mobile application and related services (collectively, the "Service") operated by Mooch ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

2. Description of Service

Mooch is an AI-powered local deal discovery application that helps users find deals, promotions, happy hours, and specials at local businesses. The Service uses artificial intelligence to surface deal information and third-party data sources to verify business details.

3. Eligibility

You must be at least 13 years of age to use Mooch. By using the Service, you represent that you meet this age requirement. Users under 18 should review these Terms with a parent or guardian.

4. Account Registration

To use Mooch, you must create an account using a valid mobile phone number. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Providing accurate and current information
  • Notifying us immediately of any unauthorized use of your account

5. SMS Verification

Account creation and login require SMS verification. By providing your phone number, you consent to receive one-time verification codes via SMS from Mooch. Standard message and data rates from your carrier may apply. We do not send marketing or promotional SMS messages.

6. Dig Credits and Purchases

Mooch operates on a credit-based system ("digs") for AI-powered deal discovery:

  • Free accounts receive a limited number of digs per month
  • Additional digs may be purchased through the app via in-app purchase
  • Purchased digs are non-refundable except as required by applicable law
  • Digs have no cash value and cannot be transferred between accounts
  • We reserve the right to modify dig pricing and availability with reasonable notice

7. Deal Information Accuracy

Mooch uses AI to discover and surface deal information. Please note:

  • Deal information is generated by artificial intelligence and may not always be accurate, current, or complete
  • Business details (hours, address, phone, website) are sourced from Google Places API and may change
  • We do not guarantee the availability, accuracy, or terms of any deal displayed in the app
  • Always verify deal details directly with the business before visiting
  • Mooch is not responsible for deals that are unavailable, expired, or different from what is displayed

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse engineer, scrape, or extract data from the Service
  • Create multiple accounts to abuse free dig credits
  • Interfere with or disrupt the integrity or performance of the Service
  • Impersonate any person or entity
  • Submit false reports or feedback about businesses or deals

9. Intellectual Property

The Mooch app, including its design, code, branding, and content, is owned by Mooch and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MOOCH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOOCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability shall not exceed the amount you paid to Mooch in the six months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Mooch and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.

13. Third-Party Services

The Service integrates with third-party services including Anthropic, Google, and Twilio. Your use of these third-party services is subject to their respective terms and privacy policies.

14. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us.

15. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by updating the effective date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Salt Lake County, Utah.
